People ex re/. Phoenix v. District Attorney of Onondaga County, 407 N.Y.S.2d 790, 95 Misc.2d 572 (N.Y. Co. Ct., 1978). When the State of New York maintained its criminal records illegally and in a manner that caused prejudice and damage to a citizen, Brock Green sued the New York District Attorney to have the records either returned to his client or sealed. The Judge agreed with Mr. Green and ordered all records returned or sealed.
